Since 1 July 2024, criminal procedure in India runs under the Bharatiya Nagarik Suraksha Sanhita, offences under the Bharatiya Nyaya Sanhita, and evidence under the Bharatiya Sakshya Adhiniyam. Section numbers have changed; most of the principles have not. We work with both the old and the new codes, because many pending cases began under the old ones.

When you are complaining

A complaint is far more likely to be acted on when it reads like evidence: who, what, when, and which documents prove it. We draft it that way, follow it up with the police, and approach the Magistrate when an investigation does not begin.

When you are accused

Speak to an advocate before you give a statement. Where there is a real risk of arrest, an application for anticipatory bail under Section 482 BNSS is the first step. Many complaints that arise out of property and family disputes are, at heart, civil disputes; where that is so, the High Court has the power to quash them.
